		<Abstract>&lt;span&gt;In the event of the governance of the Warsaw Conventions (including the Hague Protocol of Amendment) and Montreal in international flights, the liability of the carrier for the life of the passenger begins upon the commencement of the operations of carriage and terminates upon their completion. Determining the scope of the carrier&#039;s liability—that is, the time and boundary of the commencement and termination of this liability under the purview of Article 17 of these two Conventions—is one of the challenging issues in private international air law, as neither of the Conventions specifies by what action and from what time the operations of carriage commence, and how they terminate&lt;/span&gt;&lt;span dir=&quot;RTL&quot; lang=&quot;FA&quot;&gt;.&lt;/span&gt;&lt;span&gt;Judicial practice and doctrine have attempted to elucidate the concept of &quot;operations of embarking and disembarking&quot; since the inception of the Warsaw Convention&#039;s governance. Despite providing solutions such as the &quot;safe place&quot; test, especially the so-called Day test, which is based on three criteria—the location of the passenger, the activity of the passenger, and the degree of control by the carrier (the passenger&#039;s freedom of action)—and although it is somewhat helpful, it faces ambiguity in complex cases and when confronted with the technological advancements of airports and the air transport industry, such as smart gates and automated connecting tunnels&lt;/span&gt;&lt;span dir=&quot;RTL&quot; lang=&quot;FA&quot;&gt;.&lt;/span&gt;&lt;span&gt;This article employs a descriptive-analytical method with a comparative approach, studying the doctrine and judicial practice from various countries. While examining the Day test, it critically analyzes its underlying basis. The research findings indicate that this theory’s focus on indicators such as the passenger&#039;s activity or proximity to the gate, while useful, can be inadequate in providing a correct answer to contemporary disputes&lt;/span&gt;&lt;span dir=&quot;RTL&quot; lang=&quot;FA&quot;&gt;.&lt;/span&gt;&lt;span lang=&quot;FA&quot;&gt; &lt;/span&gt;&lt;span&gt;To fill this gap, the article proposes a new theory entitled &quot;Operational Dominance.&quot; Instead of focusing on often-relative criteria, this theory bases liability on the structural and functional foundation of the operations of embarking and disembarking. To determine the scope of the carrier&#039;s liability, this theory introduces three criteria: first, the structural necessity of the process; second, the carrier&#039;s systematic dominance; and third, the controllable operational risk&lt;/span&gt;&lt;span dir=&quot;RTL&quot; lang=&quot;FA&quot;&gt;.&lt;/span&gt;&lt;span lang=&quot;FA&quot;&gt; &lt;/span&gt;&lt;span&gt;Analysis of cases that resulted in disagreement between the lower and higher courts shows that this theory can, while aligning with the protective objectives of the Warsaw and Montreal Conventions, prevent the unjustified expansion of carrier liability and provide clear, coherent, and predictable criteria for the courts&lt;/span&gt;&lt;span lang=&quot;EN&quot;&gt;.&lt;/span&gt;</Abstract>
			<OtherAbstract Language="FA">&lt;span lang=&quot;FA&quot;&gt;در صورت حکومت کنوانسیون‌های ورشو (با لحاظ پروتکل اصلاحی لاهه) و مونترال در پروازهای بین‌المللی، مسئولیت متصدی حمل ‌و نقل در برابر جان مسافر از زمان شروع عملیات حمل ‌و نقل آغاز و با پایان یافتن آن خاتمه می‌یابد. تعیین قلمرو مسئولیت متصدی حمل و نقل یعنی زمان و محدوده آغاز و پایان این مسئولیت تحت سیطره ماده 17 این دو کنوانسیون از موضوعات چالش برانگیز در حقوق بین‌الملل هوایی خصوصی است چرا که هیچ یک از کنوانسیون‌ها مشخص نکرده‌اند که عملیات حمل‌ و نقل با چه اقدامی و از چه زمانی آغاز می‌شود و در آن سو چگونه پایان می‌یابد. تلاش‌های رویه قضایی و همین‌طور دکترین برای تبیین مفهوم «&lt;em&gt;عملیات سوار شدن و پیاده شدن&lt;/em&gt;» به آغاز حکومت کنوانسیون ورشو باز می‌گردد و علی رغم ارائه راه حل‌هایی نظیر «&lt;em&gt;مکان امن&lt;/em&gt;» به ویژه آزمون موسوم به &lt;/span&gt;&lt;span dir=&quot;LTR&quot;&gt;Day&lt;/span&gt;&lt;span lang=&quot;FA&quot;&gt; که بر سه معیار موقعیت مکانی مسافر، فعالیت مسافر و میزان کنترل متصدی(آزادی عمل مسافر) بنا شده است و با آنکه تا حدودی راهگشاست اما در پرونده‌های پیچیده و در مواجهه با پیشرفت تکنولوژیک فرودگاه‌ها و صنعت حمل و نقل هوایی نظیر گیت‌های هوشمند و تونل‌های اتصال خودکار با ابهام مواجه می‌شود.&lt;/span&gt;&lt;br&gt;&lt;span lang=&quot;FA&quot;&gt;این مقاله با روش توصیفی-تحلیلی و با رویکرد تطبیقی به مطالعه دکترین و رویه قضایی از کشورهای مختلف پرداخته و ضمن بررسی به نقد مبنایی آزمون &lt;/span&gt;&lt;span dir=&quot;LTR&quot;&gt;Day&lt;/span&gt;&lt;span lang=&quot;FA&quot;&gt; می‌پردازد. یافته‌های پژوهش نشان می‌دهد که تمرکز این نظریه بر شاخص‌هایی نظیر فعالیت مسافر و یا نزدیکی به گیت همان‌قدر که مفید است می‌تواند در ارائه پاسخ صحیح به اختلافات امروزی ناتوان باشد.&lt;/span&gt;&lt;br&gt;&lt;span lang=&quot;FA&quot;&gt;برای پر کردن این خلأ مقاله نظریه جدیدی تحت عنوان «&lt;em&gt;تسلط عملیاتی&lt;/em&gt;» را پیشنهاد می‌کند. این نظریه به جای تمرکز بر معیارهای اغلب نسبی، مسئولیت را بر مبنای ساختاری و کارکردی عملیات سوار و پیاده شدن بنا می‌کند. این نظریه برای تعیین محدوده مسئولیت حامل، سه ضابطه را مطرح می‌کند: نخست، ضرورت ساختاری پروسه؛ دوم، تسلط سیستماتیک حامل و سوم، خطر عملیاتی قابل کنترل. &lt;/span&gt;&lt;br&gt;&lt;span lang=&quot;FA&quot;&gt;تحلیل پرونده‌هایی که دچار اختلاف بین دادگاه تالی و عالی شده‌اند نشان می‌دهد که این نظریه می‌تواند ضمن همسویی با اهداف حمایتی کنوانسیون‌های ورشو و مونترال، از توسعه ناموجه مسئولیت حامل جلوگیری کرده و معیارهایی شفاف، منسجم و قابل پیش‌بینی برای محاکم فراهم آورد.&lt;/span&gt;</OtherAbstract>
